Overview: منذ ثمانينيات القرن العشرين والدكتور وائل حلاق [1] ينهض بمشروع أكاديمي يهدف إلى إعادة كتابة تاريخ الفقه الإسلامي أصولا وفروعا. وقد سطَّر في هذا المجال دراسات كثيرة توَّجها بثلاثة كتبٍ [2] هي خلاصة ما انتهى إليه مشروعه الفكري الذي يهدف أساسا ـ وكما يحدد المؤلف نفسه ـ “إلى زعزعة الخطاب الاستشراقي وتقويضه ومناهضته بمشروع أكاديمي منفصل بنيويا عن خطاب الهيمنة الغربي”[3]، ولكن هذا الهدف كما يؤكد المؤلف لا يمكن تحقيقه من خارج نطاق هذا الفكر الاستشراقي. إذ إنه قد نجح في تهميش جميع الانتقادات التي قدمها الكتَّاب العرب والمسلمون من خارج معاقل هذا الفكر تهميشا كاملا [4].المقولات الاستشراقيةيبحث هذا الكتاب في العلاقة بين الكتابات في أصول الفقه والواقع الفقهي، ويثبت بينها نقاط تماس وتشابكات بنيوية قد تجاهلها الخطاب الاستشراقي، وهو تجاهل يهدف إلى عزل الشريعة بأجمعها عن الواقع الاجتماعي، حاكماً عليها بالتهميش التاريخي. فقد ركز الخطاب الاستشراقي، على نحو أساسي، على علاقة أصول الفقه بعلم الكلام كأساسٍ لفهم منطلق أصول الفقه ووظائفه الدينية النظرية. مهمِّشاً بذلك علاقة أخرى لها بالغ الأهمية، ألا وهي العلاقة بين أصول الفقه والفقه من جهة، وبين الشريعة كمنهجية فكرية، والممارسات الشرعية في المجتمعات الإسلامية المختلفة عبر العصور من جهة أخرى.يضاف إلى ذلك الأسطورة الاستشراقية القائلة بأن الشريعة قد توقفت عن النمو والعمل بعد القرن الثاني أو الثالث بعد الهجرة، وعُبِّر عن ذلك بمقولة أخرى تنص على أن باب الاجتهاد قد أغلق إلى أبد الآبدين. ومن ثمَّ فإن العالم الإسلامي لم يخرج من حال الانحدار والجمود إلا مع قدوم الحضارة الغربية بقوانينها ونظمها التشريعية التي فُرضت عليه.أصول الفقه: مرحلة التكوينيذهب د. حلاق، خلافا لكثير من العلماء المعاصرين، إلى أن الفقه الإسلامي لم يبدأ مع مطلع القرن الثاني للهجرة، بل تعود بداياته إلى ما بعد منتصف القرن الأول عندما نُقلت عاصمة الإمبراطورية الإسلامية إلى دمشق، وخضعت أراض شاسعة للحكم الإسلامي.. فقد شهدت هذه الفترة ثورة في النشاط الفقهي الذي ساهم فيه العرب المسلمون ومعتنقو الإسلام من غير العرب، ولم يعد الاهتمام بالمسائل الفقهية محدودا بنخبة تمتعت بالحظوة لارتباطها بالنبي (صلى الله عليه وسلم) أو بصحابته.وقد لاحظ المؤلف في سياق تحليله لتطور المصادر التشريعية والمفاهيم الفقهية في هذه الفترة، التغيرات التدريجية التي طرأت على هذه المصادر والمفاهيم، بداية من الأعراف والممارسات الإدارية التي كانت سائدة في الولايات المختلفة وتأثّر بها الفقهاء، ثم حاولوا، مع تزايد الاعتماد على الأحاديث والمرويات، تثبيتها من خلال الأحاديث النبوية.ومع ظهور حركة قوية هدفت إلى ترسيخ الفقه كاملا في النصوص الدينية الموثوق بها، تغيرت طبيعة التفكير الفقهي؛ وخضع مفهوما الرأي والاجتهاد، وأنواع الاجتهاد إلى تغير في البنية والمعنى؛ فمع حلول منتصف القرن الثاني أشار مصطلح الرأي إلى نوعين من التفكير: أولهما: الاجتهاد الإنساني الحر المستند إلى اعتبارات عملية وغير الملزم بنصٍ موثوق به، أما الثاني: فهو الاجتهاد الحر المستند إلى نص موثوق والمحفَّز من اعتبارات عملية. ومع تنامي الحركة الدينية في القرن الثاني تم التخلي تدريجيا عن النوع الأول لمصلحة الثاني الذي خضع بدوره لتغييرين مهمين: فمن جهة تمَّ ترقية إسناد النصوص الموثوق بها، التي تشكل قاعدة مثل هذا النوع من الاجتهاد والتي نسبت إلى مرتبة أدنى من مرتبة النبي (صلى الله عليه وسلم) إلى مرتبة السنة النبوية. ويمثل مذهب الشافعي ذروة هذه العملية، ومن جهة أخرى تغيرت نوعية الاجتهاد لمصلحة طرائق أكثر صرامة ومنهجية، فقد جرى التخلي عن مصطلح الرأي واستبدلت به مصطلحات أخرى مثل الاجتهاد والقياس. وعلى هذا النحو تابع المؤلف حديثه عن نشأة مفهوم الإجماع والاستحسان وتطورهما.الشافعي وبداية تأصيل الفقهمنح العلم المعاصر الشافعيَّ امتياز مؤسس أصول الفقه. وأدى اعتبار الشافعي مؤسساً لأصول الفقه إلى الاعتقاد بأنه ما إن وضع نظريته حتى أبصرت أصول الفقه النورَ، وأن المؤلفين اللاحقين ساروا ببساطة على دربه. وبعبارة أخرى، ساد اعتقاد بوجود استمرارية غير منقطعة في تاريخ أصول الفقه بين رسالة الشافعي والكتابات اللاحقة حول الموضوع.وقد أظهرت بحوث المؤلف أن هذه الاستمرارية لم توجد قط، وأن صورة الشافعي كمؤسس لأصول الفقه هي ابتكار متأخر. وأن أصول الفقه كما نعرفها الآن لم تبصر النور حتى أواخر القرن الثالث، الذي لم ينتج بحثا كاملا عن أصول الفقه، كما أن رسالة الشافعي نفسها لم تولد أي تعليق أو دحض لدى مؤلفي هذه الحقبة. ولكن رسالة الشافعي تمثل المحاولة الأولى لتجميع الجهد المنتظم للاجتهاد البشري، والاستيعاب الكامل للوحي كقاعدة الفقه الأساسية. ولكن التوفيقية التي روج لها الشافعي جاءت في وقت لم يرغب الكثيرون في اعتناقها، سواء من أهل الكلام الذين لم يقبلوا بفرضية أن الوحي هو الحكم الأول والأخير في الشؤون البشرية، ولا التقليديين الرافضين مبدأَ القياس الذي طرحه الشافعي.تقعيد أصول الفقه ما بعد الشافعيإن أقدم حقبة لدينا عنها سجل حافل في أصول الفقه هي القرن الخامس للهجرة، فقد تم فيه طرح المشاكل الرئيسية للنظرية الفقهية، وتم تعبيد الطريق لتحليلات أكثر دقة. كما شهد نشر عدد مذهل من الأعمال الأصولية، هذا فضلا عن بروز ألمع وأبرع منظري أصول الفقه.وخلافا لبنية الشافعي الأولية وغير المخطط لها تُظهر نظريات القرن الخامس وعياً عميقاً بالبنية. فقد فرض واقع استنباط الفقه من نصوص الوحي بطريقة مباشرة وغير مباشرة بنظر الأصوليين بنيةً خاصة تتجلى فيها المواضيع وترتبط بعضها ببعض. وقد لخص المؤلف هذه البنية في العناصر الأساسية التالية:أ ـ نظرية المعرفة: والتمييز بين الظن واليقين.ب ـ أصول التشريع وحجية القرآن والسنة.ج ـ البحوث المتعلقة بتحديد القيمة المعرفية للنصوص وفقا لضعف نقلها أو قوته، وبحسب الوضوح المعنوي لمضامينها...

Not bad, but not my favorite. The writing was fine, but I didn't feel very connected to the characters. They felt a bit flat. It's fine if you have nothing else to read.
